Mediation and Allocation

Our experts have extensive experience representing clients in diverse mediation and allocation projects ranging from two to hundreds of potentially liable parties (PLPs), including preparation of compelling advocacy reports. When a site requires legal determinations, our experts can partner with an attorney, either through existing relationships or as recommended by the PLPs, to provide complementary turnkey mediation or allocation services that address both legal and technical site issues. For decades, we have helped clients and law firms develop cleanup cost-sharing processes that are effective, efficient, cost-conscious, and equitable. These processes can be complex and challenging, requiring expertise in communications, environmental regulations, engineering, and science. We excel at identifying the technical elements that are critical to resolving cleanup disputes.

We use our experience to “right-size” the allocation approach, developing an appropriate and technically sound method for the Site, informed by a realistic assessment of the likely fact record and data.

Testifying and Non-Testifying Expert Support

Our experts have served in many successful mediations and trials. Our expert analysis and reports bring the best of our expertise into compelling and persuasive arguments.

We also serve as non-testifying experts on several active complex projects, assisting with identifying and interviewing experts, expert preparation, technical trial support, deposition attendance, and input into case strategy. This dual experience informs our holistic appreciation for the challenges of executing a complex case.

Our expert services are grounded in our collective decades of experience working on state and federal contaminated sites, including remedial investigations, feasibility studies, remedial design, and construction oversight. We understand and have lived the process and can testify from a position of direct experience and as practitioners, not just hired experts.

Data Analytics, Geospatial Analysis, and Visualizations

In addition to our expertise with dispute resolution, one of the things that sets us apart is our Data and Geospatial Analysis Capabilities.
